MORE THAN 9.8 million people are detained in penitentiary services (commonly, but not limited to, jails, remand/detention centres and prisons) around the world.1 Inmates are at greater risk of becoming infected with Mycobacterium tuberculosis, and of de-veloping tuberculosis (TB) disease, than people in the general population due to their close, prolonged in-door confi nement and other associated conditions common among inmates.2 The varying durations of incarceration pose challenges for quantifying the mag-nitude of the TB problem in the inmate population.3 The incidence of TB in prisons ranges from 5 to 70 times higher than within the general population.2,4,5 Concomitant conditions, particularly human immuno-defi ciency virus (HIV) infection, injecting drug use

Independent forensic neuropsychological examinations are performed by neuropsychologists who are hired as independent contractors by third parties to make determinations regarding neuropsycho-logical functioning. The responsibilities of neuropsychologists when performing independent or court-ordered forensic examinations differ from those of clinical examinations. Because neuropsychological training typically occurs in clinical contexts, the transition to forensic contexts may result in uncertainty about how to negotiate the unique responsibilities of the forensic examiner role. Neuropsychologists are responsible for maintaining the highest standards of professional practice when performing indepen-dent and court-ordered forensic examinations. To reach and maintain the highest standards of practice, neuropsychologists must understand the unique relationships with retaining parties and examinees and strive to maintain true independence and objectivity. Although a true neuropsychologist–patient relationship is not considered to exist within the context of a forensic neuropsychological evaluation, neuropsychologists have ethical responsibilities to both the retaining party and the examinee.

Forensic neuropsychological evaluations are often constrained by the demand that a third party observer be present during the course of interview and formal testing. This demand may originate from counsel’s desire to ensure that the neuropsychologist does not interrogate or unfairly question the plaintiff with respect to issues of liability and to ascertain if test procedures are accurately administered. In general, neuropsychologists should have the right to carry out their examination in a manner that will not in any way jeopardize, influence or unduly pressure their normal practice. The presence of a third party observer during the administration of formal test proce-dures is inconsistent with recommendations promulgated in The Standards for Educa-tional and Psychological Testing (APA, 1985) and Anastasi (1988), that the psychologi-cal testing environment be distraction free. More recently, standardized test manuals (for example, The WAIS-III, WMS-III Technical Manual; The Psychological Corpora-tion, 1997) have specifically stated that third party observers should be excluded from the examination room to keep it free from distraction.
